Terms and Conditions.

By agreeing to use the website and services of We Ship It, LLC, you, as the customer, shipper, and/or cosignee (hereinafter collectively, “Customer”) are agreeing to be bound by these terms and conditions, which no employee, agent, or independent contractor of either party has the authority to waive or alter. 

By agreeing to use the website and services of We Ship It, LLC, you, as the customer, shipper, and/or cosignee (hereinafter collectively, “Customer”) are agreeing to be bound by these terms and conditions, which no employee, agent, or independent contractor of either party has the authority to waive or alter. 

Customer is responsible for providing accurate weights, dimensions, descriptions, and special handling requirements of the freight. Customer understands that all freight is quoted for business to business delivery. Customer agrees there is an additional charge for any residential pickup and/or delivery as defined by the freight carrier. Customer agrees to provide the means to load and unload the freight, unless these services have been prearranged for an additional charge. Customer warrants the locations for pickup and delivery will be accessible to the freight carrier. Customer, or their authorized representative, must be onsite for delivery. Customer understands that certain situations may result in addition charges being incurred, including, but not limited to, pick up/delivery at a residence; detention time to load/unload; driver load/unload; scheduled deliver time; limited access locations, such as storage lots, etc.  We Ship It, LLC reserves the right to adjust quotes and/or invoices if the initial quote or invoice was based upon incorrect or incomplete information provided by Customer or additional services were required. 

All BOLs are non-negotiable and will be prepared by We Ship It, LLC in accordance with Customer’s instruction and the information provided by Customer. All BOLs are final and cannot be altered without the consent of We Ship It, LLC. Altering the BOL may change the shipping charges.

All charges are payable in U.S. Dollars and due at the time Customer books the shipment, unless We Ship It, LLC approves Customer’s written application to pay on terms. Payment on terms requires all charges to be paid within thirty (30) days of delivery. Customer understands any unpaid invoice, or portion thereof, will be subject to a finance charge of five percent (5%) per month or the maximum rate allowed by law. We Ship It, LLC accepts payments via ACH, PayPal, and credit cards with American Express, Discover, MasterCard, and Visa. A three percent (3%) surcharge will be added to all invoices paid by credit card. Customer agrees that any adjustments made to an invoice, including, but not limited to, additional services, re-weighs, or re-classifications, may be automatically debited from Customer’s credit card and/or bank account. Any disputes with the additional charges must be emailed to accounting@weshipit-llc.comwithin thirty (30) days of the charge. Any disputes made after the thirty (30) days will be denied.

Customer affirms he/she provided true and accurate information to We Ship It, LLC; Customer is at least eighteen (18) years of age; Customer is authorized to enter into these terms; and the credit card used for payment is issued in Customer’s name or Customer is authorized to use the credit card. 

We Ship It, LLC, as a freight broker, accepts no liability on behalf of the carrier or Customer and is not liable for damages. The filing of a claim does not relieve Customer of the obligation for payment of the freight charges due We Ship It, LLC.

Customer is responsible for inspecting all shipments upon delivery and noting any damage or shortage on the bill of lading. We Ship It, LLC will make reasonable efforts to cooperate and assist with resolving claims for freight loss, theft, shortage, or damage. When doing so, Customer will fully cooperate with We Ship It, LLC and provide any and all pictures of damage and documentation necessary to support the claim.  In the event We Ship It, LLC pays a claim made by Customer, Customer automatically assigns any and all of its rights and interest in the claim to We Ship It, LLC. 

Unless Customer requests freight insurance in writing, which is confirmed by We Ship It, LLC in writing, We Ship It, LLC is under no obligation to purchase freight insurance on Customer’s behalf. Failure of Customer to purchase additional freight insurance limits Customer’s recovery to that provided for in the terms of the freight carrier’s general rules of tariff.

WE SHIP IT, LLC MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO SHIPMENTS, WAREHOUSED GOODS, ITEMS IN TRANSIT, OR DELIVERIES, OR WITH REGARD TO THE INFORMATION PROVIDED ON ITS WEBSITE OR SERVICES RELATED TO TRANSACTIONS CONDUCTED ON ITS WEBSITE. WE SHIP IT, LLC CANNOT GUARANTEE DELIVERY BY ANY SPECIFIC TIME OR DATE. IN NO EVENT SHALL WE SHIP IT, LLC BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING DAMAGES RELATING TO LOSS OF PROFITS OR INCOME, WHETHER OR NOT SUCH DAMAGES WERE REASONABLY FORESEEABLE WE SHIP IT, LLC’S ENTIRE LIABILITY TO A CUSTOMER FOR ACTUAL DAMAGES FROM ANY CAUSE WHATSOEVER, INCLUDING, WITHOUT LIMITATION, ITS NEGLIGENCE, SHALL NOT EXCEED $50.00 PER SHIPMENT. 

If any legal action, claim, fine, or penalty is sought against We Ship It, LLC due to any act, omission, or negligence of Customer, Customer agrees to indemnify and defend against any and all such actions, claims, fines, penalties, demands, losses, costs, and obligations.

If legal action is required, Customer agrees that such action will take place in Stark County, Ohio and Customer will be responsible for all court costs and legal expenses, including reasonable attorney fees.

We Ship It, LLC has the right to modify and/or add any term to these terms and conditions and will be effective as of the posting of the same on its website.
